Capitalized terms not defined herein shall have the meanings ascribed to them in our Terms. Section 2. What Information Do We Collect?
We may collect information about you in three ways: information we gather from your use of our Services, information you provide to us, and information collected from other third parties, each as further described below. Information you provide us. We collect the content, communications, and other information you provide when you contact us, participate in surveys, or otherwise utilize any portion of our Services that requires you to provide us with your information, including without limitation, your email address, your name, address, email address, age, birth month and year, state of residence, phone number, Service passwords, and in certain circumstances, payment and billing information.

We may obtain information about you from other sources, including through third-party services and organizations to supplement information provided by you. For example, if you access our Services through a third-party login service or a social networking site, we may collect information about you from that third-party service that you have made public via your privacy settings. Information we collect through these services may include your name, your user identification number, your username, location, gender, birth date, email, profile picture, and your contacts stored in that service. This supplemental information allows us to verify the information that you have provided to us and to enhance our ability to provide you with information about our business, Products, and Services.
Section 3. How Do We Use This Information?
We are able to deliver, personalize, and improve our Services by combining and using the information that we have about you to understand how you use and interact with our Services. We also may use the information that we have about you for the following purposes:

Such other purposes as you have specifically consented to, are notified of or are disclosed when you provide your Personal Information to us.
In connection with the foregoing, we may combine your Personal Information that we have with other information that we obtain from service providers or other companies. We may also combine your Personal Information with Non-Personal Information. When Personal Information and Non-Personal Information are combined, such combined information will be treated as Personal Information for the duration of such combination.
Section 4. How Do We Share This Information?
We will not share the Personal Information we collect about you with any third party for their own marketing purposes without your consent, which consent may be gathered at the time you initially use our Services or as and when you use particular types of our Services, or both. Except as set forth below, we do not sell, license, or share information that individually identifies our users with companies, organizations, or individuals outside of the Company and its affiliated entities. We will share your information in the following ways:

Our vendors, subcontractors, and business partners (“service associates”): We may share your data with our services associates who process your Personal Information to provide portions of our Services to you, to fulfill our offers and orders for our Products and Services with respect to same, and/or to enable such service associates to provide their services to us or you or on our behalf, which services may constitute a part of our Services, including Shopify and/or ShippingEasy Fulfillment. We have contracts with our service associates that prohibit them from sharing the information about you that they collect or that we provide to them with anyone else or using it for other purposes, except where you have otherwise consented to their further use.

Advertisers and advertising networks: Advertisers and advertising networks place ads (including sponsored links in search results) on or through our Services. These companies may collect information, such as your computer’s IP address, mobile identifiers, page(s) visited, location, time of day, browser information, and search queries, as you use our Services, including through the use of Technologies. We may also combine and share such information and other information (such as demographic information and past purchase history) with third-party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third-party websites within their networks and to send directly to your browser the advertisements and links that appear in the Services. They may also use other technologies (such as cookies) to measure the effectiveness of their advertisements and to personalize the advertising content you see. These advertisers may also use information regarding your use of the Services, such as the number of times you viewed an ad, to determine which ads to deliver to you. Sale or merger of our business: We may transfer your Personal Information to a third party if we or any of our affiliates are involved in a corporate restructuring (e.g., a sale, merger, or other transfer of assets) or in connection with financing due diligence, reorganization, bankruptcy, or receivership.

We disclaim and shall have no liability or obligation in connection with any third-party actions or omissions concerning your information, even if those acts or omissions are a result of our sharing and disclosure your information, as allowed pursuant to this Privacy Policy. Section 5. How Do We Use Cookies, Tracking Technologies, and Analytics Services?
We, as well as third parties that provide content, advertising, or other functionality on the Services (including service associates and advertisers), may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Services. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with our Services.

Common ID Cookie

We may currently or in the future use web analytics companies to assist us in measuring the effectiveness of our Services. This requires that we allow such web analytics companies to include their own pixel tags and cookies on the Services. We use this information to help us learn things like overall user preferences, click-through rates means to improve our Services, and the types of offers that are of most interest to our users. Section 6. How Long Do We Keep the Information?
We will keep your information only for as long as it is necessary to fulfill the purposes of use described above unless longer retention is required or permitted by law. In determining how long to retain information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information (as well as the other factors listed above) may dictate different retention periods for the same types of information. For example, we retain your email address as an authentication credential (where applicable) as long as you have an account with us and an additional period of time after that for our legitimate interests, and for our fraud and legal compliance purposes. If you opt out of email marketing, we maintain your email on our suppression list for an extended time to comply with your request. We may also choose to anonymize certain information you provide to us so that it can no longer be attributed to you if we would like to retain it for longer periods of time.
Section 7. How Do We Protect Your Personal Data?
We take the protection of your Personal Information very seriously. Only our employees, contractors, service associates, and agents will have access to your Personal Information, except as otherwise provided for in this Privacy Policy. We maintain technical, physical, and administrative security measures designed to provide reasonable protection for your personal data against loss, misuse, unauthorized access, disclosure, and alteration. The security measures include firewalls, data encryption, physical access controls to our data centers, and information access authorization controls. While we are dedicated to securing our systems and Services, you are responsible for securing and maintaining the privacy of your password, if any, used in connection with your use of our Services. While we take precautions against possible breaches in our Services and databases, we cannot guarantee that it is completely secure. We are not able to assure you that unauthorized hacking, access, data loss, or other breaches will never occur. As such, your use of our Services is at your own risk. The Services may contain links to other websites and online offerings offered by third parties (“Third Party Offerings”), and other Third Party Offerings may reference or link to our Services. These Third Party Offerings are not controlled by us. We encourage you to read the privacy policies of each Third Party Offering with which you interact. We do not endorse, screen, or approve and are not responsible for the privacy practices or content of such other Third Party Offerings. Visiting or using these Third Party Offerings is at your own risk. We assume no responsibility for the actions or omissions of these third parties, whether they receive such information from us directly or otherwise (such as through Technologies), except as specifically set forth herein. You should direct any questions you have about such third parties’ privacy practices and/or software directly to such third parties. In addition, social media buttons such as Google, Facebook, or X (formerly Twitter) (that might include widgets such as the “share this” button or other interactive mini-programs) may be on our Services. These features may collect your IP address, and which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our site. Your interactions with these features apart from your visit to our site are governed by the privacy policy of the company providing it.
Section 9. Age Limitations.
Our Services are not directed to persons under the age of 18 (21 in Utah and Tennessee and as otherwise set forth in our Terms). We do not knowingly collect information, including Personal Information, from children or other individuals who are not legally able to use our Services. If we obtain actual knowledge that we have collected Personal Information from a person under the age of 18, we will promptly delete it, unless we are legally obligated to retain such data. Section 10. Jurisdiction and International Data Transfers
We do not represent or warrant that our Services are appropriate or available for use in any particular jurisdiction. Those who choose to access the Services do so on their own initiative and at their own risk and are responsible for complying with all local laws, rules, and regulations. We may limit access to our Products and Services, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion. Please see our Terms for specific geographic areas where our Products are not available for sale under any circumstances. The Company may transfer your Personal Information to countries other than the one in which you live. In particular, your Personal Information will be transferred to and processed in the United States where many of our central databases operate. By using our Services, you are consenting to such cross-border data transfers of your Personal Data, as set forth in this Privacy Policy. By using the Services, you acknowledge that the data protection and other laws of other countries, such as the United States, may provide a less comprehensive or protective standard of protection than those in your country, and consent to your Personal Information being collected, processed and transferred as set forth in this Privacy Policy and US law.
Section 11. Accessing, Reviewing, and Changing Your Personal Information.
Depending on what country (countries located in the European Economic Area for instance) or state (California or Virginia for instance) you are located in, you may have certain legal rights in relation to your Personal Information. You may have the right to request access to your Personal Information that we retain, as well as to seek to update, delete, or correct this Personal Information, subject to certain exemptions provided by law. We cannot guarantee that you will be given access to your Personal Information in all circumstances, except those mandated by law. Additionally, if we are unable to verify your identity or are required to retain certain of your information by law, we may not be able to modify or delete your Personal Information but will do so in all cases required by applicable law.

With respect to the Personal Information we collect from you, we are relying on one of the following as our legal basis to do so:

California Residents Shine The LightUnder California Civil Code Section 1798.83, which is also known as the “Shine The Light” law, users who are California residents may request from us a list of the Personal Information (if any) that we have disclosed to third parties for direct marketing purposes during in the preceding calendar year, this includes the names and addresses of such third parties. Requests may be made only one time per year. These requests are free of charge. To make a request, please contact us at privacy@mitra-9.com or at the address or phone number set forth below. We cannot be responsible for notices that are not labeled or sent properly or that do not have complete information. In the body of such request, you must put the statement “Your California Privacy Rights”, as well as your name, street address, city, state, and zip code, and you must provide enough information for us to determine if this applies to you. Additionally, you must attest to the fact that you are a California resident and provide a current California address.
California Consumer Privacy Act (CCPA) If you are a resident of California, you also have certain additional rights under the California Consumer Privacy Act of 2018, as amended (CCPA), including the right:

If you are using an authorized agent to exercise your rights to opt-out we may deny a request if such authorized agent does not submit proof that they have been validly authorized to act on your behalf. We will use and retain the collected personal information as described in Section 6 below, but in any case for no longer than 2 years unless retention is required to meet legal or regulatory requirements or needs. We may disclose your personal information with our service providers (as defined under CCPA) pursuant to a written contract between us and each such service provider which requires such service provider to abide by the data protection obligations of the CCPA. We may use your personal information for our business purposes, as more particularly described in Section 3 above. Such use is not a “sale” of your personal information under the CCPA.
